The Engineering Council of South Africa (ECSA) has confirmed that a registered person implicated in the George building collapse has lodged an appeal against a disciplinary tribunal’s finding of improper conduct. The George building collapse appeal was submitted by the Respondent referred to in ECSA’s earlier media statement of 22 July 2025.

Appeal Lodged Under the Engineering Profession Act

The Respondent has lodged an appeal against the guilty finding of improper conduct by the disciplinary tribunal in terms of section 32(3) of the Engineering Profession Act 46 of 2000 (“the Act”). Accordingly, in terms of section 33(4) of the Act:

  • the decision of the disciplinary tribunal under section 32(3); or
  • the publication by the council in terms of section 32(5)

may not be put into effect before the council or the CBE, or both, has decided the appeal.

The Statutory Right to Appeal

Section 33 of the Act provides the statutory right for a registered person who has been found guilty of improper conduct by a Disciplinary Tribunal to appeal against the finding, the sentence, or both. This appeal mechanism ensures that ECSA’s disciplinary process is subject to further scrutiny and that decisions comply with the principles of legality, reasonableness, and procedural fairness.

ECSA remains committed to following due process and acting in accordance with its statutory mandate to regulate the engineering profession in the public interest.
