The Engineering Council of South Africa (ECSA) has confirmed court litigation proceedings brought by a select few of its recognised Voluntary Associations seeking a ruling from the High Court. The ECSA court litigation follows the recent appointment of the council’s 5th term. ECSA received court papers from SAICE on Friday, 03 March 2017.
ECSA’s position in the matter
As a statutory council that regulates and registers engineering practitioners, ECSA’s mandate falls under the Department of Public Works, which upholds the legislative authority for the built environment in its entirety. ECSA is the second respondent in this matter.
The applicant’s allegation
The applicant is alleging that due processes were not observed and complied with by the Department of Public Works and ECSA in the appointment of the 5th term Council, which was inaugurated in September 2016.
ECSA’s response
ECSA reserved the right not to make any further comment until the court rules on the matter, stating that it remains focused and committed to the achievement of its legislative mandate. The council said it is undeterred by these developments and remains focused on the delivery of its transformation trajectory for the benefit of the engineering sector and South Africa in general.
